Customer Agreement

By creating an account, accessing VideoShark, using any feature, or purchasing a plan or making a Recharge, you agree to this Agreement, our Special Terms, Privacy Notice, and Refund Policy.

You must be at least 18 years old or the age of majority in your location, whichever is higher, and legally able to enter into this Agreement. You must provide accurate account information. If you use the platform for an organization, you confirm that you have authority to bind that organization.

The Services provide an online workspace for AI-assisted text, image, audio, and video creation, together with related storage, account, billing, and usage features.

We may add, change, suspend, or remove features to operate, secure, maintain, or improve the Services. Some features depend on third-party AI, hosting, storage, or payment providers and may be subject to their own terms.

The Services, features, payment methods, and third-party provider integrations may be available only in certain countries or regions and may vary by Service, provider, account, or applicable law. The Services are not offered or available in mainland China (the mainland territory of the People's Republic of China), including for registration, access, generation, storage, payment, or other use. We may identify permitted territories through the Services, checkout, account notices, provider requirements, or other reasonable communications. You may access and use each Service only in a permitted territory.

You may not access or use the Services from, in, or for the benefit of any country, territory, person, or entity where that access or use is prohibited by applicable sanctions, embargoes, export controls, import controls, or other trade restrictions. You represent that you are not a sanctioned person or entity, are not owned or controlled by one, are not acting on behalf of one, and will not use the Services for a prohibited end use. If you use the Services for an organization, you must ensure that your Authorized Users and End Users meet these requirements.

You must not misrepresent your location, identity, organization, or intended use, or access the Services from mainland China, whether directly or through a VPN, proxy, relay, or other technical means. You must not use any such means to evade a geographic, identity, payment, or access restriction. We may request information or documentation reasonably necessary to verify location, identity, ownership, authorization, payment, or compliance.

We may refuse, limit, suspend, or terminate access to an account, feature, purchase, or generation request if required by law or a government authority, if a provider imposes a restriction, if we cannot complete a compliance review, or if continued access would create a legal, regulatory, security, sanctions, export-control, or other compliance risk. Any refund, credit, or treatment of unused SharkCoin remains subject to the Special Terms, Refund Policy, and mandatory rights under applicable law.

You are responsible for keeping your login credentials confidential and for activity performed through your account. Do not share credentials, allow unauthorized access, or use another person's account.

Notify us through the support channel in your account if you believe your account has been compromised. We may restrict access while investigating security, fraud, abuse, or compliance concerns.

You retain the rights you have in prompts, files, images, audio, video, text, and other materials that you submit to the platform ("Inputs"). You grant us and our service providers a limited license to host, process, transmit, and display Inputs and generated results as necessary to provide, secure, troubleshoot, and improve the Services, as described in the Privacy Notice.

You are solely responsible for having the rights, permissions, and consents needed for your Inputs and for your use or publication of generated results. Do not upload personal data, copyrighted material, a person's likeness, voice, or other protected material unless you are allowed to do so.

AI results may be inaccurate, incomplete, biased, similar to results generated for other users, or unsuitable for your intended purpose. You must review results before relying on, publishing, or distributing them. We do not guarantee that any result is unique, accurate, lawful, or free from third-party claims.

You may not use the Services to:

• break the law, violate another person's rights, or facilitate harm;
• create or distribute malware, scams, fraud, spam, or deceptive content;
• infringe intellectual property, privacy, publicity, or other rights;
• create non-consensual intimate content, targeted harassment, or impersonation;
• bypass access controls, rate limits, credit controls, or security measures;
• reverse engineer, scrape, copy, resell, or exploit the Services; or
• interfere with the security, availability, or operation of the Services.

We may remove content, limit features, suspend an account, or terminate access when reasonably necessary to enforce this Agreement, protect users, comply with law, or protect the Services.

You are responsible for claims, losses, disputes, costs, and expenses that arise from your Inputs, generated results, publication or use of generated results, misuse of the Services, violation of this Agreement, or violation of another person's rights.

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold us harmless from those claims, including reasonable legal fees and costs. This does not require you to indemnify us for claims caused solely by our own unlawful conduct.

The software, interface, design, branding, documentation, and underlying technology are owned by us or our licensors. Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose.

You may not copy, modify, distribute, sell, sublicense, or create a competing service from the platform or its underlying technology. Feedback you voluntarily provide may be used by us to improve the Services without creating an obligation to compensate you.

We may rely on third parties for AI models, payment processing, hosting, storage, email, analytics, and other infrastructure. Third-party services may have separate terms, availability limits, or privacy practices.

To the fullest extent permitted by applicable law, we are not responsible for third-party services, third-party content, provider outages, provider decisions, or losses caused by your use of third-party services.

Some features require a subscription, Recharge purchase, or SharkCoin balance. SharkCoin is a platform usage entitlement only and is subject to the billing, expiration, consumption, correction, and refund rules in the Special Terms and Refund Policy.

We may provide promotional, compensation, migration, registration, welcome, or system-granted SharkCoin. Granted SharkCoin is not cash, cannot be withdrawn or transferred, and may be corrected or removed as described in the Special Terms.

The Services are provided on an as-available basis. We do not promise that they will always be uninterrupted, error-free, secure, or available at a particular time. Maintenance, outages, provider failures, network problems, and events outside our reasonable control may affect availability.

If a service problem occurs, we will use commercially reasonable efforts to help investigate and resolve the issue. This support commitment does not create a service credit, refund, compensation, or damages obligation unless required by applicable law or expressly stated in the Refund Policy.

You are responsible for keeping copies of prompts, files, generated results, and other content that you want to preserve. We may store content to support your workspace, but we do not guarantee that stored content will always be available, complete, unchanged, or recoverable.

We may delete or restrict access to content as part of ordinary operations, account management, security controls, legal compliance, or enforcement of this Agreement.

You may stop using the Services at any time. We may suspend or terminate access if you breach this Agreement, fail to pay amounts due, create a security or legal risk, abuse the Services, or where required by law.

Termination may end access to the Services and any unused benefits, subject to applicable payment terms and mandatory legal rights. Provisions concerning ownership, content responsibility, disclaimers, liability, and dispute resolution survive termination where their nature requires.

To the fullest extent permitted by applicable law, we disclaim warranties that the Services or AI results will be accurate, complete, secure, uninterrupted, fit for a particular purpose, or free of third-party rights claims. You use the Services and rely on generated results at your own risk.

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, goodwill, data, or content, arising from or related to the Services.

If we are found legally responsible for a claim relating to the Services, then, to the fullest extent permitted by applicable law, our total liability will not exceed the fees you paid for the affected Services during the twelve months before the event giving rise to the claim. Nothing in this Agreement excludes liability that cannot legally be excluded or limited.

We may update this Agreement when the Services, law, or our business changes. We will publish the updated version with a new effective date when appropriate. Continued use after the effective date means you accept the updated Agreement, except where applicable law requires another form of consent.
